1. About these terms
These terms are between you and Green Turtle Media Ltd, trading as Green Turtle Timing (“Green Turtle Timing”, “we”, “us”), a company registered in England and Wales (company number 14017193, registered address 27 Durnells, Didcot, OX11 6JP). Contact: privacy@greenturtletiming.com.
They apply to clubs and series that use the service, and to everyone with an account (members, competitors, parents and guardians, officials). By using the service you agree to them.
Entering a club’s event or joining a club is also covered by that club’s own terms, which the club publishes on its club pages. If those conflict with these terms about the club’s events, the club’s terms apply to that event; these terms always apply to the use of the platform itself.
2. The service
Green Turtle Timing gives karting clubs, in one system:
- a club website with events, online entries and payments, membership, news and tickets;
- race-day tools: signing on, scrutineering, reception, race control, officials’ records and decisions;
- timing software for the circuit, with live timing, results, championships and records published online;
- accounts for competitors and parents to enter, pay, sign on and follow their results.
We improve the service over time and may change or remove features. We will not remove a feature a club relies on without reasonable notice.
3. Club responsibilities
A club using the service is responsible for:
- its own terms, entry conditions, membership rules and privacy information for its members and entrants;
- running its events in line with Motorsport UK regulations and its permits, including the decisions of its officials;
- the data it collects and uploads: having a lawful basis for it, keeping it accurate, and answering its members’ data requests (we act as the club’s processor, see the privacy policy);
- who it gives access to, and with which roles and permissions, and removing access when someone leaves;
- its own accounts with payment, text message and accounting providers (Square, Stripe, Twilio, Xero, QuickBooks), and their fees;
- the timing equipment and computers at the circuit, and having a fallback for timing on the day.
4. Accounts and two-step sign-in
- Give accurate details and keep them up to date. One account per person; a parent or guardian runs the account of a driver under 18.
- Keep your password private and do not share your account. Tell us or your club straight away if you think someone else has used it.
- Club administrators and officials who sign decisions must use two-step sign-in. Anyone else can switch it on, and we recommend it.
- We may suspend an account that is being misused or that puts the service or other people at risk, and will tell you why where we can.
5. Acceptable use
Do not use the service to:
- break the law, or upload data you have no right to share;
- harass, threaten or impersonate anyone, or publish offensive content;
- try to get into accounts, clubs or data that are not yours, or get round security or two-step sign-in;
- disrupt the service, overload it, scrape it, or test its security without our written permission;
- copy the live timing feeds or results for commercial use without permission (developers can request access to our live feed).
6. Availability and maintenance
We aim to keep the service available at all times, and especially on race days, but cannot promise it will never be interrupted. Current status and past incidents are on status.greenturtletiming.com.
Updates are announced there as planned maintenance and normally take a few minutes. Timing runs on the computer at the circuit and keeps working if the internet is lost; results are sent to the cloud when the connection returns.
7. Fees and billing
Clubs pay for the service according to their plan, shown in the dashboard under Billing, with invoices there too. Competitors and members do not pay us; they pay their club’s entry fees and memberships through the club’s own payment provider.
- Invoices are due by the date shown on them. Prices and plan changes are given with reasonable notice.
- If an invoice is overdue, the club is marked past due and keeps access for a grace period; after that, access to the dashboard may be suspended until it is paid. An event already running always finishes, and public results and live timing stay online.
- A club’s data is never deleted for non-payment.
8. Timing and results
Timing depends on equipment at the circuit (decoders, loops and transponders), its set-up and the signal on the day. We take care that the software records and calculates correctly, but live timing and provisional results may contain errors.
Official results are the responsibility of the club and its officials (the timekeeper, Clerk of the Course and stewards), who check and declare them under Motorsport UK regulations. Results shown as provisional can change, and decisions and penalties are the officials’, not ours.
9. Your content and our software
Clubs and users keep ownership of the data and content they upload. You give us permission to store, process and display it as needed to run the service, including publishing results and live timing the club makes public.
The software, design and brand of Green Turtle Timing remain ours. You may not copy, resell or reverse-engineer them.
10. Liability
We provide the service with reasonable care and skill. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Otherwise:
- we are not liable for losses that were not reasonably foreseeable, or for loss of profit, revenue, business or goodwill, or for losses caused by things outside our reasonable control (including failures of the internet, power, circuit equipment or other providers);
- we are not responsible for race results, officials’ decisions, or how a club runs its events;
- for a club, our total liability in any 12 months is limited to the fees the club paid us in those 12 months; for users who do not pay us, to £100.
If you use the service as a consumer, you also have your legal rights, which these terms do not affect.
11. Ending the service and your data
Clubs
A club can stop using the service at the end of its billing period by telling us. Before leaving, it can export its members, results and reports from the dashboard, and we will provide a full copy of its data in a common format on request. After that we keep the data only under the retention rules in the privacy policy and then anonymise it.
We may end a club’s use of the service on reasonable notice, or straight away for serious breach of these terms or non-payment.
Account holders
You can stop using your account at any time and ask us to close it. Records your clubs must keep (for example results and race-day records) stay with those clubs under the retention rules.
12. Changes to these terms
We may update these terms and will change the date at the top. For changes that matter, we will tell clubs and account holders by email before they apply.
13. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings there. Please contact us first: most problems can be sorted out quickly.
